General Terms and Condition of Services

1. SCOPE OF APPLICATION

The following Terms and Conditions apply supplementary to the General Terms and Conditions for Works and Services provided by MDI Calibration. Including the laboratory and customer responsibilities, information and consulting related to the performance of calibration services.

 

2. ACREDITATION

The MDI Calibration Laboratory has been accredited by Perry Johnson Laboratory Accreditation, Inc. (PJLA) in accordance with the internationally applicable standard ISO/IEC 17025 and is subject to meets the Requirements of ANSI/NCSL Z540-1-1994.

 

3. CALIBRATION

ISO/IEC 17025 is an international standard that assesses the technical competency of calibration laboratories. ISO/IEC 17025 covers every aspect of laboratory management, ranging from testing proficiency to record keeping and reports. It goes several steps beyond all work in accordance with ISO 17025, MDI Calibration Quality System and Quality Manual.  Key aspects of the service will include:

  1. All calibration standards will be traceable to the National Institute of Standards and Technology (NIST).

  2. Calibration recall notification will be provided for each device at least twenty (20) days prior to the calibration due date.

  3. If repairs and/or replacement are required prior to performing the service, an estimate of time and cost will be provided. Repairs will be done only with customer approval.

  4. The service level, either with or without data and uncertainties, is to be determined on a per item basis.

  5. Traceable certificates of calibration will be provided only when unit passes test. As-found and as-left data will be recorded and provided to the customer if requested by customer in writing prior to service.

  6. Calibration due dates to appear on the calibration certificate and label will be determined by the client and do not imply continued conformance to specification.

 

4. LABORATORY RESPONSABILITES

 

COMPLAINTS

Customers complaints received will be immediately recorded and corrections will be made if is possible. Complaints will be forwarded to manager/supervisor (where applicable) to determine whether a corrective action needs to be taken to prevent recurrence.

 

RECORD KEEPING

MDI will maintain records of calibration and repair history in hard copies or Software version for a period of between two to five (2-5) years depending on the type of record.

MDI will produce a calibration certificate only when units pass test.

MDI will not make changes on technical reports related to calibration results, date of calibration or any information that could affect the authenticity of reports.

 

PRICING

MDI Calibration agrees to maintain the quoted calibration service pricing for a period of one (1) month, provided that a firm purchase order and/or contract for the work quoted is received within thirty (30) days. 

MDI calibration will apply an extra charge of thirty (30) % for rush services for most items.

Minimum on site calibration fee will be $350.00. Service includes calibration and basic calibration adjustment(s) if necessary. Excess dirt/grime/deposits on tooling that requires additional labor to be removed in order to properly calibrate will be billed at an hourly rate of $50.00 per hour in addition to the calibration cost for the tool.

Prices of service from MDI Calibration do not include sales, use, excise, or similar taxes. Consequently, the amount of any present or future sale, use, excise or other tax applicable to the sale of the products hereunder shall be paid by the Customer in addition to the invoice amounts.

 

SHIPPING AND RETURNS OF EQUIPMENT

Unless otherwise stated by MDI Calibration, delivery of products hereunder shall be as follows:

Equipment will be delivered to clients via preferred freight carrier FedEx. Shipment and transportation expenses shall be paid by the client. Client shall determine whether shipments should be insured and notify MDI in writing of this option and the amount of insurance for each shipment.

Products distributed by MDI Calibration are carefully packed before leaving our facility. Any claim for discrepancies will be honored only if reported within (30) days from receipt of shipment.

Responsibility for safe delivery of products is assumed by the carrier upon its acceptance of the shipment.

When returning equipment, please advise the reason for the return, date of purchase, your P.O. number, and our invoice number. This will expedite proper adjustment of your account. Returns will be granted only if all of the following conditions are met:

  1. Product being returned has not been used or altered in any way

  2. All accessories and packaging are undamaged, unused, and with the unit

  3. The request for return  is within thirty (30) calendar days of the invoice date

  4. The request for return is not for a special order item

 

5. CUSTOMER’S RESPONSIBILITY

 

ON-SITE CALIBRATION

When work is performed at a Customer’s site, it is the responsibility of the customer to have instruments available in advance of the scheduled date and allow for access to the tooling in order to accommodate calibration and to facilitate steady workflow.

MDI Calibration requests the Customer’s cooperation in providing the on-site technician(s) with an environmentally controlled area to perform calibrations and to stage instruments. This area must have proper lighting and electrical service as well as adequate space to set up our work equipment.

If equipment cannot be safely calibrated on-site, it must be taken to the calibration laboratory for service.

 

IN- HOUSE CALIBRATION

When the work will be performed in the laboratory, MDI provides safe handling of customer equipment during receiving, testing and packing.

Laboratory turnaround time for each regular service is seven (7) working (business) days.

It is the customer’s responsibility to ensure instruments sent to the laboratory are free of contamination in accordance with State & Federal transportation and/or safety requirements.

 

CALIBRATION INTERVALS

Calibration intervals are to be determined by the instrument “owner” based on manufacturer recommendations or on equipment owner’s internal quality procedures. MDI Calibration makes no recommendation regarding the accuracy of the intervals determined by the Customer.

If the calibration interval is not specified in the purchase order or recorded in the MDI Calibration files from prior customer instruction, the laboratory will assign one (1) year calibration cycle interval for all equipment. Calibration due dates Are determined by the customer.

 

SCHEDULING AND APPOINTMENTS FOR SERVICE

Regular services will be scheduled by email or phone call by the customer. Rush services will be scheduled by a phone call, or email by the customer. The customer is responsible for requesting on-site and Rush services with sufficient notice to meet their internal requirements. At no time will MDI be responsible for scheduling customer service calls without a customer request unless contractually obligated otherwise.

 

DELIVERIES AND PICK UP

MDI Calibration will offer deliveries and pick up to the clients at no extra charge twice a week. It is the customer’s responsibility to request pick-up and delivery services.

 

6. GENERAL TERMS AND CONDITION

 

EQUIPMENT EVALUATION FEE

If a unit is sent in for calibration only but is found to need repair, there will be an extra charge applied depending on the magnitude of the reparation. Customer will be notified prior to the reparation.

If a unit is sent in initially for repair there will be an evaluation fee applied depending on the magnitude of the evaluation. Customer will be notified prior to the service being provided.

 

TERMS OF PAYMENTS

Invoices are due and payable in full upon receipt unless other terms have been agreed to by MDI Calibration.

Methods of payment accepted by MDI include Cash, Company Check, and Credit Card (Visa/ MasterCard). Net thirty (30) credits are available with approved customer credit application.

 

INFORMATION AND CONSULTING

Information and consulting with regard to calibration services and their results shall be provided solely and exclusively on the basis of MDI Calibration experience. The values and procedural steps given here shall be regarded as average values and standard procedural steps. Any and all information about the results of calibration services, in particular the information regarding precision, measurement, and performance as well as technical data contained in the offers and/or other printed materials from MDI shall be viewed as approximate average values unless MDI has expressly designated it as a binding.

 

LIMITED WARRANTY

All calibrations have a 30-day warranty from the date of service, unless the unit is found to have broken or removed Cal-void seals, or has obvious physical damage. MDI Calibration warrants that all units meet the manufacturer's published specifications that were valid on the original manufacture date of the unit at time of test only. Warranty is limited to recalibration of instrument only and specifically excludes any liability for injuries, lost time or damaged product. MDI calibration warrants that any item calibrated by it, found to be out of tolerance within thirty (30) days, due to defects in workmanship, including parts or process, will be recalibrated at no charge if such item is returned to Company’s facility, at the Customer’s expense.

 

ACCEPTANCE OF TERMS AND CONDITION

Acceptance of the terms and conditions herein is an essential prerequisite to any contract of sale made by the seller. No condition stated by the Customer in its offer or acceptance shall be binding upon the seller if in conflict with, inconsistent with, or in addition to the terms and conditions contained herein. Acceptance of any good manufactured and delivered hereunder shall constitute purchaser’s agreement to said terms and conditions.

 

CHANGES OF TERMS AND CONDITIONS OF SERVICES

If a current or future provision of the concluded contract should be or become, in whole or in part, invalid/void or unenforceable for reasons other than those stated in these terms and condition, the validity of the remaining provisions of the contract shall not be affected.
